Instrumental amendment to the Labor Code adopted

On 4 February 2021, the National Council of the Slovak Republic adopted the so-called "small amendment“ of the Labor Code, introducing several sought-after changes concerning both employers and employees.

The amended piece was subject to heated debate since the introduction of the preliminary information within the interdepartmental review process in summer 2020. AmCham´s Employment and Social Affairs Committee representatives, after submitting their comments, participated on the dispute-resolution meeting at the Ministry of Labor on 20 October 2020. Following the President´s signature on February 17, the amendment will become effective as of 1 March 2020. Bringing changes not only to the Labor Code itself, but also directly affecting other labor-related laws, the amendment:

  • provides employees with an opportunity to choose between a meal voucher or financial allowance on food;
  • redefines relationships within the Governmental Economic and Social Council (“Tripartite”) and setting the minimum of three (3) organizations to be officially representing both employees and employers;
  • reinforces definitions of “home office” and “telework”, while imposing the necessity for an employer and an employee to agree on “household” as a place outside of employer´s premises, where the employee will conduct the work from. Conditions to work from home were also redefined;
  • creates a new dismissal reason – concurrence of the completed age of 65 and the retirement age.
