Streamlining Justice: EU Electronic Evidence

How can new EU legislation on the collection of electronic evidence improve cross-border cooperation in criminal matters? 


In April 2018, following a call by the European Council and the Council, the European Commission proposed new rules to make it easier and faster for judicial authorities to access electronic evidence, wherever such data is located. Directive 2023/1544 complements Regulation 2023/1543 of the EP and the Council of the EU, which allows for the direct transmission of orders issued by the competent judicial authorities of EU MS to service providers. 


The event is organized by the American Chamber of Commerce in the Slovak Republic (AmCham Slovakia) in cooperation with the Republic Union of Employers (RÚZ), IT Association of Slovakia (ITAS), Communication Technology Forum (CTF) and the Association of Mobile Operators of Slovakia (ASMOS).


The workshop is primarily intended for mandatory service providers:

  • electronic communication services, 
  • Internet domain name and IP address services; and
  • other information society services.


The subject matter of the workshop may also be of benefit to law firms dealing in this area.


The addressees of the obligations under the above legislation are natural or legal persons providing cross-border services as defined in Article 2(1) of Directive 2023/1544 of the European Parliament and of the Council of the EU.


Through a discussion with representatives of the Ministry of Justice of the Slovak Republic, you will have the opportunity to discuss in more detail the purpose and objectives of this legislation, the resulting obligations and requirements for obliged persons, the relationship between the Regulation and the Directive as well as related aspects of the implementation of this legislation.
